These Terms of Service (“Terms”) govern your use of americantoolrentals.com (the “Site”), including member accounts, online pricing, and reservation requests. The Site is operated by American Tool Rental (“American Tool Rental,” “we,” “us”), 181 2nd Ave, Brooklyn, NY 11215. By creating an account, logging in, or using the Site, you agree to these Terms. If you do not agree, please do not use the Site, and call us at 718-344-1474 to rent by phone.
1. Rental agreement controls
These Terms cover the Site only. Every rental is also governed by our rental agreement, which you sign or accept before equipment leaves our yard or is delivered. If these Terms and a signed rental agreement conflict about a rental, the rental agreement controls.
2. Accounts and approval
You must be at least 18 years old and able to enter a binding contract to create an account. You agree to give accurate, current information and to keep it up to date from the My Profile page. Accounts are reviewed by our staff. We may approve, decline, suspend, or remove any account at any time, for any lawful reason, including when we cannot verify the information provided. Pricing and online reservations are available only to approved members.
You are responsible for keeping your password confidential and for all activity under your account. Tell us right away if you think someone else has used it. If you sign in with Google, your use of Google is also subject to Google’s terms.
3. Reservation requests are not confirmed rentals
Submitting a reservation request on the Site does not create a confirmed rental and does not charge you. A reservation is confirmed only when our staff accepts it. Equipment availability can change, and we may decline or change a request if equipment is unavailable, if there is a problem with the account, or if a delivery cannot be made safely. We will invoice you separately for the final amount.
4. Pricing and estimates
Rates shown to approved members and the estimate displayed on the reservation form are for convenience only. Estimates do not include transportation (delivery and pickup) fees, fuel, damage waiver, or taxes. The final amount is the amount on your invoice. We may correct pricing errors and may change rates, availability, and fees at any time. Rates can be paused or withdrawn without notice; when rates are not displayed, please call for current pricing.
5. Delivery, pickup, and use of equipment
Delivery is made to the jobsite address you provide, and you are responsible for safe, legal access and for any permits. Store pickup is available at 181 2nd Ave, Brooklyn. You agree to use equipment only for its intended purpose, in line with the manufacturer’s instructions and all applicable laws, to use only trained and, where required, certified operators, and to return equipment on time and in the condition received, normal wear excepted. Rental, fuel, cleaning, damage, loss, and late-return charges are set out in your rental agreement and invoice. Aerial lifts, forklifts, and similar equipment can cause serious injury; you are responsible for safe operation and proper fall protection.
6. Cancellations and changes
You can cancel a pending reservation request from My Reservations or by calling 718-344-1474. For confirmed reservations, please call us as early as possible. We may charge for work already performed, such as a delivery that was dispatched, as described in your rental agreement.
7. Payment
We invoice you for your rental. Payment terms, accepted payment methods, deposits, and credit terms are described on your invoice and in your rental agreement or credit application. We may require a deposit, card on file, or credit approval for any rental.
8. Acceptable use of the Site
You agree not to misuse the Site. That includes attempting to gain unauthorized access, interfering with its operation, using automated tools to scrape or overload it, submitting false information or reservations, creating accounts for others without permission, or using the Site for any unlawful purpose. We may block access or remove content or accounts that violate these Terms.
9. Content and intellectual property
The Site, including its text, images, logos, and design, belongs to American Tool Rental or its licensors and is protected by law. You may view and use the Site for your own rental needs. You may not copy, republish, or sell any part of it without our written permission. Product photos and descriptions are for general reference and may not exactly match the equipment you receive.
10. Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties for the Site, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, error free, or free of harmful components. Any warranties on rented equipment are limited to those stated in your rental agreement.
11. Limitation of liability
To the fullest extent permitted by law, American Tool Rental and its owners, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or project delays, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to the greater of $100 or the amount you paid us for the related rental. Nothing in these Terms limits liability that cannot be limited by law. Liability for equipment rentals is addressed in your rental agreement.
12. Indemnity
You agree to defend and hold harmless American Tool Rental and its owners, employees, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, your misuse of the Site, or your use of rented equipment, as further described in your rental agreement.
13. Privacy
Our Privacy Policy explains how we collect and use information. By using the Site you agree to it.
14. Changes to the Site and these Terms
We may change the Site or these Terms at any time. The “Last updated” date above shows when these Terms last changed. Continued use of the Site after a change means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict of law rules. Any dispute about these Terms or the Site will be brought in the state or federal courts located in Kings County, New York, and you consent to those courts’ jurisdiction.
